The meeting of the working group "Location of business (registration and lease of property)" of the World Bank Group project "Business Enabling Environment"

On December 28, 2023, the meeting of the "Location of business (registration and lease of property)" working group of the Commission on Business Environment and International Ratings was held in video-conference format.

At the meeting, the implementation status of the measures planned in the Road Map for 2023 regarding the implementation of improvements in the relevant field related to the "Location of business (registration and rental of property)" indicator was discussed. In this regard, Elshad Mammadov, Deputy Chairman of the Management Board of the public legal entity "State Cadastre and Registry of Real Estate" made a detailed speech and answered the questions of the meeting participants.

In his speech, E. Mammadov also informed the meeting participants about Decree No. 2354 dated November 17, 2023. He said that Decree envisages the transfer of the documents issued by various registration offices, which are the basis for the registration of rights, to a digital format, and for citizens to carry out relevant operations related to real estate without coming to the registration body. If the "one stop shop" principle currently applied in the field of registration of rights to real estate regulates issues related to the registration based on notarized documents, Decree No. 2354 means expanding the scope of this principle and applying it to cases of initial registration of rights.

Leyla Barkhudarzadeh, the head of the Supervisory-analytical work group at the Ministry of Justice's Head department of services in the field of justice, spoke about the "single payment order" and its application during the notarial approval of the purchase and sale of real estate. "Single payment order" is the corresponding payment issued by the notary for all payments required for the notarial sale of real estate and the registration of rights over it (acquiring information about encumbrance, notarizing the contract, issuing an extract, collecting taxes, collecting compulsory insurance, etc.) provides for centralized payment on the basis of the order.

At the meeting also was discussed the preparation of the Road Map for 2024 for the "Registration and lease of property" indicator. According to the results of the discussions, it was decided that the members of the working group would submit proposals regarding the draft of the Road Map.

The meeting was attended by the members of the "Location of business (registration and lease of property)" working group, as well as the Head of the Secretariat of the Commission for Business Environment and International Ratings.
